These Text Messaging Terms of Service (“Terms”) govern your consent to receive, and your use of, SMS/MMS text message communications from Project Resources Group, Inc. (“PRG,” “we,” “us,” or “our”). The Terms apply whenever you opt in to receive text messages from PRG, including through the Text Messages opt-in form on our website through our Contact Us page at https://www.prgus.com/text-messages/, through a job application, or through our applicant tracking system in connection with recruiting, or through another third-party (together, the “SMS Program”). By opting in, you agree to these Terms. To opt out, at any time, you may reply STOP to any message.
These Terms supplement, and do not replace, our Privacy Policy, which describes how we collect, use, and protect personal information generally. Insofar as there is a conflict between this and our privacy policy, for purposes of the Text Messages, these Terms control.
1. Description of the SMS Program
PRG uses text messaging to communicate about matters that may include, without limitation: updates related to our services and projects, scheduling and appointment reminders, general customer or business communications, and — for job applicants and candidates specifically — application status updates, interview scheduling, requests for information needed to process an application, job opportunities that may be of interest, onboarding and pre employment steps, and other recruiting-related communications.
Recruiting-related messages are sent through our applicant tracking system, Rippling, a workforce management software provider. PRG does not send text messages for unrelated third-party marketing purposes through this program.
2. Eligibility and Consent to Receive Messages
You must be at least 18 years old, or the age of majority in your jurisdiction, to opt in to the SMS Program. By providing your mobile phone number and opting in — whether by checkbox, verbal consent, submitting a job application, or otherwise providing your number and agreeing to be contacted by text — you represent that you are the owner or authorized user of the mobile number provided. You further agree that you are authorizing any charges related to the communications.
Consent to receive text messages is not a condition of purchasing any goods or services from PRG and is not a condition of employment. You may still apply for and be considered for positions with PRG or its clients, or receive PRG’s services, without opting in to text messages.
You remain equally eligible for any position with PRG regardless of whether you opt-in to receive messages. Declining or opting out of SMS messaging will not impact your hiring or recruiting process/eligibility other than to define how you will be contacted.
3. Message Frequency
Message frequency varies depending on your relationship with PRG and, if applicable, your application status and recruiting activity. Frequency may increase or decrease depending upon the number of positions you apply for or your recruiting status. On days when you are actively being recruited, in contact with PRG recruiting teams, or otherwise providing information to PRG, you can expect to receive between five (5) and ten (10) messages a day, sometimes more, depending upon your responses and follow-up questions. On days you are not actively being recruited, you can expect to receive fewer or no messages. If at any time you no longer wish to receive messages, you can opt-out.
4. Message and Data Rates
Message and data rates may apply, depending on your mobile carrier and plan. PRG does not charge for text messages sent through the SMS Program, but your carrier’s standard messaging and data rates apply to messages sent and received. Contact your carrier for details about your plan.
5. How to Opt Out
You may opt out of the SMS Program at any time by replying STOP to any text message you receive from PRG. After you opt out, we will send you a one-time confirmation message and will not send you further text messages, except as needed to confirm your opt-out or as otherwise permitted by law. If you opt out, PRG may still contact you by phone, email, or mail, including about a job application or our services, unless you separately opt-out of all communications by emailing [email protected].

7. Supported Carriers; Carrier Liability
The SMS Program is available on most major U.S. wireless carriers. PRG is not liable for delayed or undelivered messages. PRG does not guarantee that any text message will be received in a timely manner, or at all, due to factors outside our control, including but not limited to carrier network issues, your device settings, or your carrier’s spam filter.
8. Privacy and Use of Your Information
Our collection and use of personal information in connection with the SMS Program, including your mobile phone number, is described above and in our Privacy Policy. Your mobile opt-in information and consent will not be shared with third parties or affiliates for their own marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties for purposes unrelated to providing the SMS Program. This information may be shared with Rippling for technical support and administration of our SMS program.
9. User Conduct
In connection with the SMS Program, you agree not to:
● Provide a mobile phone number that is not your own, or that you are not authorized to enroll.
● Use the SMS Program for any unlawful, fraudulent, harassing, or abusive purpose.
● Attempt to interfere with, disrupt, or gain unauthorized access to the SMS Program or its underlying systems.
● Violate any federal or state laws in connection with your use of the SMS Program.
10. Changes to the SMS Program and These Terms
We may modify, suspend, or discontinue the SMS Program, in whole or in part, at any time. We may also update these Terms from time to time. Updated Terms will be posted at this same web address. Your continued participation in the SMS Program after changes take effect constitutes acceptance of the updated Terms.
11. Disclaimer of Warranties
THE SMS PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PRG AND ITS OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS (INCLUDING ITS TEXT MESSAGING PLATFORM PROVIDER) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SMS PROGRAM OR THESE TERMS.
13. Relationship to Employment
Nothing in these Terms creates an employment relationship, guarantee of employment, or contract for employment between you and PRG or any PRG client. These Terms govern only your participation in the SMS Program.
14. Governing Law and Arbitration
These Terms are governed by the laws of the State of North Carolina without regard to its conflict-of-laws principles.
By agreeing to these terms, you agree to arbitrate all claims arising out of any dispute with PRG related to the SMS policy. This includes the issue of arbitrability. Any arbitration will be conducted in accordance with the JAMS rules and any hearing will be held in Denver, Colorado.
